Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For fulfilling the purpose of these Terms and Conditions:

• Company (‘GradXs', 'GradXs India', ‘gradXs’, 'We', 'Our', 'Us') refers to ‘gradXs’, which is a registered brand name (under the Trade Mark Act) of Centre for Management Consultancy & Education Private Limited, a registered company vide CIN U80301JH2003PTC010267 incoprporated under Indian Companies Act.
• Website ('www.gradxs.com', 'the Website') refers to gradxs.com.
• Service refers to the services provided or facilitated through the Website (primarily, but not limited to, information sharing, global enrolment and student support).
• Portal refers to the website portal on "gradxs.com" for carrying out the Service.
• Device means any device which can use or access the Service such as a computer, a smartphone or a digital tablet.
• You ('User', 'Client') and related second person pronouns means or refers to the individual using the Service or accessing the Website.
• Account refers to any account created on the Portal.
• User Details refers to the data fed to the Service (through the Website or Portal) by You.
• Country refers to India.
• Terms and Conditions ('Terms') refers to these Terms and Conditions that form the entire agreement between You and the Website regarding the use of the Service. The initial draft of this agreement was created with the help of the Terms and Conditions Generator. The current version of this agreement is a result of multiple modifications on top of the initial draft.
• Clause refers to a specific section (marked by a heading in bigger font-size followed by one or more paragraphs) of these Terms and Conditions.

 

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all Users regarding the use of the Service provided on the Website.

All LIUTEBM, IICUT and other University programs are run directly by the university and none of the same are run on / from the Indian soil. GradXs India is an authorized global enrolment and student support facilitator of its partner universities.

No piece of information, logo or symbol can be reproduced without written permission from the Company.

You acknowledge that the Website (and/or the Company) is not obligated to meet your demands.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing the website or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service or visit the website.

 

Termination

GradXs reserves the right to temporarily or permanently terminate / disable Your Account without prior notice or liability, for any reason including but not limited to the Company finding / identifying User Details to be incorrect / inappropriate or a breach in these Terms and Conditions.

 

Data Collection and Privacy

The Service collects User Details for carrying out the required procedure and maintenance of User records. GradXs does not share these with any third party service other than the academic / administrative bodies involved. The Company is not obligated to remove User Details (once fed to the Service) from its records for any reason whatsoever.

The Website uses essential cookies required for facilitating the Service (eg. sessions cookie for handling user sessions) and third party cookies for analytics and social media plugins.

 

Fee Refund

Refund for any kind of fees paid by You associated with Your use of the Service can not be claimed after 7 days from the date and time of payment, be it of any amount. The Company is not obligated for refunding any fee amount paid for whatsoever reason after 7 days from the date and time of payment.

Note that the provision of Fee Refund specified in this Clause is only applicable for the "Application Fee". The Company is not obligated to refund any fee / subsequent instalments of whatsoever amount other than the "Application Fee", even if it is within 7 days from the date and time of payment.

No Warranties

The Service is provided to You 'AS IS' and 'AS AVAILABLE' and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, the Company does not make any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Website (including the Service) will be uninterrupted or error-free or will last forever; (iii) that the Service, its servers, the content, or e-mails sent from or on behalf of the Website are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

 

Service Interruption

The Company may interrupt the access to the Website including but not limited to the Service for maintainance or emergency reasons which may be scheduled or unscheduled. You agree that the Company shall not be liable for any possible damage or loss due to downtimes because of any reason whatsoever.

The Website may contain links to third-party websites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

Governing Law

Being an Indian company, only the laws of India shall be applicable on all our Services.

 

Disputes Resolution

If You have any concern or dispute about the Service, You agree to resolve the dispute by contacting the Company itself. For any of the legal proceedings, if any, the jurisdiction shall be courts at Bokaro , Jharkhand , India only.

 

Limitation of Liability

In no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever.

 

Indemnification

You agree to indemnify the Company and hold Us harmless against any legal claims and demands whatsoever, arising due to any possible reason.

 

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at Our sole discretion.
